Welcome to Old Presbytery, and thank you for choosing to stay with us.
1. Your Booking and Rights
Your booking is for accommodation at Old Presbytery and is governed by French law. Nothing in these Terms and Conditions affects any mandatory rights you may have under applicable law.
In the event of a dispute that cannot be resolved directly with Old Presbytery, you may have recourse to a consumer mediator in accordance with French law. The relevant mediator's details will be added once a mediator has been designated.
2. Prices and What's Included
The price of a Guest Room includes accommodation and breakfast.
The Apartment rate covers accommodation only and does not include breakfast. Breakfast may be purchased separately at the applicable daily supplement, communicated before purchase.
The tourist tax (taxe de séjour) is charged separately at the applicable rate unless expressly stated otherwise.
Prices for optional services and additional charges are communicated to guests before the relevant service is purchased or used.
3. Individual Bookings
Payment: Full payment (100%) is required when making the booking. Payment may be made by credit card, debit card or bank transfer, subject to the methods offered and agreed at the time of booking.
Cancellation: To receive a full refund, you must cancel at least 30 days before your check-in date. If you cancel less than 30 days before your check-in date, no refund will be provided, subject to any mandatory rights under applicable law.
No-show: If you do not arrive and have not cancelled your booking, your booking will be treated as cancelled by you and the cancellation terms above will apply, subject to any mandatory rights under applicable law.
Early departure: If you leave before the end of your booked stay, no refund will normally be given for unused nights, subject to any mandatory rights under applicable law.
Right of withdrawal: The statutory 14-day right of withdrawal does not apply to accommodation services provided on a specific date or during a specific period, as provided by Article L.221-28(12) of the French Consumer Code.
4. Group Bookings
Definition: A Group Booking is one of the following: (1) a booking for all five Guest Rooms, with the Apartment remaining available to be booked separately by other guests; (2) a booking for all five Guest Rooms with exclusive use of the entire property, the Apartment being kept unoccupied; or (3) a booking for all our rooms, including the Apartment, with exclusive use of the entire property.
Payment: Full payment (100%) is required when making the booking. Payment may be made by credit card, debit card or bank transfer, subject to the methods offered and agreed at the time of booking.
Group Booking Pre-authorisation: A pre-authorisation of €1,000 will be requested on the credit card used for the reservation on the day of check-in. This is a temporary hold, not a payment. It will normally be released after check-out, although the time taken for the funds to become available again depends on the card issuer.
If damage or other sums properly due are identified, Old Presbytery may seek payment in accordance with these Terms and Conditions and applicable law.
Cancellation: To receive a full refund, you must cancel at least 60 days before your check-in date. If you cancel less than 60 days before your check-in date, no refund will be provided, subject to any mandatory rights under applicable law.

18. Damage to Property

Old Presbytery is situated in the countryside, and we ask all guests to respect the peace and tranquillity of the property and other guests. Loud music, television or other media should not disturb others.

22. Disruptive Behaviour
Guests are expected to behave considerately towards other guests, our team and the property. This also applies to the behaviour of their dogs.
Serious or persistent disruptive behaviour may result in the booking being terminated and the guest being asked to leave, where justified under the circumstances and applicable law. Any refund or other consequences will be determined in accordance with these Terms and Conditions and applicable law.
Old Presbytery is not obliged to arrange alternative accommodation unless required by applicable law or otherwise agreed.
23. Cancellation by Old Presbytery
If Old Presbytery has to cancel a confirmed booking and cannot provide the accommodation, any payment for accommodation or services not provided will be refunded in accordance with applicable law. This does not affect any further rights or remedies available under applicable law.
24. Force Majeure
Force majeure is understood in accordance with Article 1218 of the French Civil Code.
Where an event beyond a party's control, which could not reasonably have been foreseen when the booking was made and whose effects cannot be avoided by appropriate measures, prevents performance of an obligation, the consequences will be determined in accordance with applicable law.
Where performance is temporarily prevented, the obligation may be suspended unless the resulting delay justifies termination of the contract. Where performance is definitively prevented, the contract will be terminated in accordance with the French Civil Code.
25. Governing Law
These Terms and Conditions are governed by French law. Any dispute will be dealt with in accordance with the applicable rules of French law and jurisdiction.
These Terms and Conditions are available in English, French and Dutch. Where French law requires it, the French version prevails. The French version is available at https://oldpresbytery.com/fr/terms.
